Terms of Service

Plain English summary: Use PulseBoard for your business. Pay your subscription. Do not misuse the platform. We will do our best to keep it running and useful. Either side can end the relationship with reasonable notice.

1. Agreement to Terms

By creating an account or using PulseBoard, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use PulseBoard.

These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and PulseBoard ("PulseBoard," "we," "us," or "our").

2. Description of Service

PulseBoard is a subscription-based business intelligence platform that analyzes your business sales data and generates weekly operations reports, insights, and recommendations using artificial intelligence.

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice. We will not substantially reduce core functionality without giving you at least 30 days notice and the option to cancel.

4. Subscription and Payment

Plans and billing

PulseBoard offers monthly subscription plans. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. We do not provide partial refunds for unused time within a billing period.

Refunds

If you are unsatisfied within your first 7 days of service, contact us at support@pulseboard.co for a full refund. After 7 days, payments are non-refundable except where required by law.

Price changes

We will give you at least 30 days written notice before increasing your subscription price. You may cancel before the price change takes effect.

5. Your Data and Content

You retain full ownership of all business data, sales data, and content you upload to PulseBoard. By uploading data, you grant us a limited license to process and analyze that data solely for the purpose of generating your reports.

You represent and warrant that you have the right to upload any data you provide and that it does not violate any third party rights or applicable law.

PulseBoard and its original content, features, and functionality are owned by PulseBoard and are protected by intellectual property law. You may not copy, modify, distribute, or create derivative works of any part of PulseBoard without our written consent.

Your business data and the reports generated from your data belong to you.

9. Disclaimer of Warranties

PulseBoard is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or completely secure.

10. Limitation of Liability

To the maximum extent permitted by law, PulseBoard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of your use of the service.

Our total liability to you for any claims arising from these Terms or the service shall not exceed the amount you paid to PulseBoard in the 3 months preceding the claim.

11. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your right to use PulseBoard ceases and we will delete your data within 30 days per our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Pennsylvania.

13. Changes to Terms

We may update these Terms from time to time. We will notify you by email at least 30 days before material changes take effect. Your continued use of PulseBoard after that date constitutes acceptance of the updated Terms.
